Terms of Service

These Terms of Service ("Terms") govern your access to and use of RescueLead (the "Service"), operated by Green Pines Group LLC ("RescueLead," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a business, you're agreeing on that business's behalf and confirming you have authority to do so.

1. What RescueLead does

RescueLead lets home-service businesses upload lists of their own past leads and send re-engagement email campaigns to those leads, with reply and booking tracking. You control what data you upload and what messages you send; we provide the infrastructure to store that data and deliver those messages.

2. Your account

You must provide accurate information when creating an account and keep your login access secure. You're responsible for all activity that happens under your account. You must be at least 18 years old and able to form a binding contract to use the Service.

3. Subscriptions and billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. New accounts may start with a trial period; if you don't cancel before the trial ends, billing begins automatically. You can view invoices, update payment methods, and cancel your subscription at any time from the billing portal linked in your Account settings. Cancellation stops future billing but doesn't retroactively refund the current billing period unless required by law.

4. Acceptable use — your leads and your emails

This is the most important section. RescueLead is built for re-engaging leads you already have a genuine, prior business relationship with — people who contacted you, requested a quote, or were otherwise your own customer or prospect. By uploading a list of leads, you represent and warrant that:

  • You have a lawful basis to email every contact on that list, and the list wasn't purchased, rented, scraped, or otherwise obtained from a third party without the contact's knowledge of your business.
  • Your use of the Service complies with applicable anti-spam and email marketing law, including the U.S. CAN-SPAM Act and any equivalent law in your jurisdiction.
  • You will not use the Service to send unlawful, deceptive, harassing, or unsolicited bulk email, and you will not remove, disable, or attempt to circumvent the unsubscribe mechanism built into campaign emails.
  • You will honor unsubscribe requests promptly and will not re-upload or re-contact a lead who has unsubscribed.

You're solely responsible for the content of the campaigns you send and for your compliance with the law. We may suspend or terminate accounts that we reasonably believe are being used to send spam or to contact people without a lawful basis to do so.

You also agree not to:

  • Use the Service to violate any law or the rights of any third party;
  • Attempt to gain unauthorized access to the Service, other accounts, or our underlying systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse engineer or resell the Service without our written permission.

5. Your data

You own the lead and business data you upload to RescueLead ("Your Data"). You grant us a limited license to store, process, and transmit Your Data solely to provide and improve the Service (for example, sending your campaigns and rendering your dashboard). We don't sell Your Data or use it to send our own marketing. See our Privacy Policy for details on how data is handled.

6. Service availability

We aim to keep the Service reliably available but don't guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, RescueLead and its owners/operators won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the 3 months before the claim arose.

8. Indemnification

You agree to indemnify and hold RescueLead harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, the data you upload, the campaigns you send, or your violation of these Terms or applicable law.

9. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, in particular Section 4 (Acceptable use). Upon termination, your right to use the Service ends immediately; provisions that by their nature should survive (ownership, liability, indemnification) will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Missouri, USA, without regard to conflict-of-law principles.
